Fisher Maritime personnel are regularly called upon to analyze the causes of marine casualties and personal injuries, and then act as expert witnesses in litigation throughout the US and Canada. Over the years, Fisher Maritime's personnel have analyzed more than 250 such matters. (This is in addition to our primary mission involving shipbuilding and repair contract development, management, claims and litigation support work.)
The assignments focus on a thorough analysis of all factors potentially contributing to the occurrence of the accident. Our clients include both defendants and plaintiffs whose roles have been (in alphabetical order): component manufacturers, designers, insurers, owners, passengers, repairers, seamen, and shipbuilders. The foundation of our analyses is identifying the strengths as well as weaknesses of both our client's case and the opponent's case.
The key to our successes, for which we have been commended by the courts (and praised by our clients through their repeat business) is our analytical reliance on facts rather than argumentative reliance on opinions. Some observations gather from our experience are expressed below.
